BINGO PROGRAM

Here are our terms and conditions. Please read them with attention to be a Bingo Program member.

Once you enter the Registration page, you have to complete it and you have to select the accepting terms and conditions box, which we assume you have read it and accept it.

1. Bingo Programs Rights and Obligations

1.1 Register your users

Will register your users, understanding these, as those who visit your web sites, and we will be monitoring the transactions in our sites. We reserve the right to reject users, or cancel their accounts if necessary, to ensure the performance of the established site requirements and which can be established periodically.

By "user" it is understood, visitor that enters your site Web and registers in an account in whatever site promoted through Bingo Program. With this registration, this visitant will convert in a user of the products and offered services by the Web sites promoted through Bingo Program, and as a result, the user will be under the terms and conditions of each site he registered in.

1.2 On-line information on the control panel

Our members will have online access by their account, created in our control panel, with which he will be able to i) create links to the sites promoted by Bingo Program ii) obtain different promotion resources (banners, mailers, etc) iii) obtain information about movements made by each user you referred or have sent to the sites promoted through Bingo Program.

1.3 Payout commissions

Bingo Program will pay their members a commission based on the profits that your users have generated, derived from the net (see commission sketch on item number three) we win from users that come from your site.

1.4 Modification

Bingo Program will be able to modify terms and conditions in any moment (commission sketches included) contained in this agreement. Any changes or new agreements will be communicated in our Web site.

2. Members rights and obligations

2.1 Unique account

Once you accept to participate in this member program, you accept to create one unique member account. Members are not allowed to create more than one account.

2.2 No exclusivity acceptation

By this agreement, we grant members the no exclusive right to our Web sites and the services there rendered. This agreement does not give rights in exclusive, or privileges in helping us in originated services created by your users, and obviously we have the intention of contacting with them and obtain the assistance of others in any moment to execute similar or equal sort of services. You want have the right of claim or compensation of commissions of users that come to us by other people or companies different from you.

2.3 Accepted promotions

You will be able to link with us through banners or also through text links you will get on our control panel, because these are the only way to get announced in our name.

Without our written acceptance, you will only use our approved banners and the offers and promotions for users, and you want be able to change the appearance. The syntax and appearance link and the hypertext have been designed and named by us, and they become the only authorized and allowed representation of our Web site.

We will finish our agreement immediately if there is any sort of spamming or if you announce our site in any non-authorized form.

2.4 Good Faith

The member will not benefit with unknown traffic or generated in a fraudulent way, understanding this as everything out of the contractual good faith. Bingo Program reserves all rights to retain or to not pay, all those amounts that we think are under suspicions of being generated in a fraudulent way.

2.5 Your Web site responsibility

The member will be the only responsible of development, the use and the maintenance of his Web site and of any other contents that appear in it. The member will exempt Bingo Program of any sort of claim that could exist for this reason.

The member will compensate Bingo Program for any damage, expenses or complaints that we can receive, including with no limitation, legal fees as a result of development, use, maintenance or contents of his Web site.

2.6 License to use brand products

Bingo Program in connection with the copyrights, declares and guaranties:

# Pacific title from Bingo Program and/or their license holders of copyrights

# That the authorized rights are free of any sort of complaint, charges, claims, taxes, and that nothing in his advertising is presumed as libel or defamation for any person, company or association, nor infringes the copyright or any other exclusive right that belongs to a third party.

The member must recognize that the Bingo Program sites are a brand image and a commercial name property of Euro Gaming Ltd. and Global Gaming N.V and the rest of the consortium. The member does not obtain any rights over the brand images, the commercial name, nor any other terms, graphics, text, concept or methodology used, property of the mentioned companies.

It is totally forbidden for the member the cession, copy, distribution and redistribution of copyrights owned by Bingo Program and/or their license holders. The only copyrights that the member is given are the ones inherent to the use of the services he gives.

2.7 Confidentiality Agreement

During this agreement, members could be given confidential information in relation to Bingo Program´s business, operations or technology. For example, commissions generated by a member. The member specifically promises he will not reveal confidential information to third party, physical or legal, unless they have a previous written authorization from Bingo Program.

The only use of confidential information that the member has received will be to accomplish with what is said in this agreement. The member will force himself to keep the confidential nature of the matter during the validity of the agreement, and also the year after, no matter what the cause was.

3. Commissions sketch

Bingo Program will pay the member part of the income produced by their users, consisting in a percentage on the net obtained by the users.

You can calculate the NET this way: NET= DEPOSITS- WITHDRAWALS.

The percentage on the net, that Bingo Program pays the members will change according to the exact taxes that you can find in www.bingoprogram.com in the Program/ Commission section. Bingo Program reserves the right to modify the percentages on the commissions in any moment as the amounts fixed for the net in the mentioned table, without needing a pre-warning to the member.

All the expense derived by the cashing, payment processing, e-commerce, and royalties will be paid by Bingo Program. Therefore, these expenses will not be deducted from the final amount that the member receives.

Once the formulas and the percentages are applied, if the amount that Bingo Program has to pay does not reach the amount of 50€/50$/50£ in a certain month, the amount will accumulate for the next month, and will keep on going like that, until it arrives to the indicated amounts.

Anyway, if the member wants to receive these low amounts (less than 50€/50$/50£), he must contact with affiliates@bingoprogram and, they can always request the payment exclusively through NETeller.

We inform that payments by bank transfer has an expense for commission of 30€/40$/20£.

3.1 Chargebacks/ Fraud

For "Chargeback" we will understand, amount of money we have not received from the user, or a fraudulent use of a credit card. For "fraud" we will understand, as a non-attributable charge to a certain credit card for a fraudulent act.

Bingo Program will not take charge of any costs that deriver from chargebacks and frauds, and in general, all those amounts that have not really been received from the user.

4. Forms and periodicity of the payments

Bingo Program will pay their members their commissions monthly, the payment will be done every 10th of each month. Payments will be made in euros/dollars or pounds. If the member´s balance is negative at the end of the month (users benefits exceed the deposits), next month the balance will be settled to zero.

5. Agreement in force

5.1 This agreement will be in force once the member puts a cross on the terms and conditions box and presses "accept".

This agreement can finish unilaterally by either parties of the contract. For this purpose, just sending an email will be enough, without detriment of future verifications that the parties would like to make. But, during three consecutive months, if the member does not send new visitors to the promoted Bingo Program sites, or there is no new deposit during this time, the account will close automatically, with no need of a written notification.

5.2 The end of the agreement: consequences

Once the end of the agreement is over, the member will have to remove all the authoring marketing tools, and all the links between the member´s site and Bingo Program´s sites.

From this moment, all the rights and licenses given to the member in this agreement, will arrive to an end immediately. The member, will have the right to receive all the outstanding bills until the agreement finishes. From that moment, he will have no right to receive profits obtained by the users. By accepting this agreement, the member gives up the payments of these commissions.

In the case that the member does not fulfill his obligations established in the contract, we reserve our right to deduct the payment of his commissions, and even compensate with the possible amounts that his breach of contract has generated.

The continuance of a member in Bingo Program´s sites does not represent the renovation of this agreement.

5.3 Banning

The member has specifically banned to make a deposit himself or through third parties (family, friends, members, etc) to increase in a fraudulent way his commissions.

6. Parties Relation

This agreement does not represent any commercial, legal, work-related relation, different as it is supposed in the contract.

The member will not be able to do or accept offers in Bingo Programs name.

7. Legal Responsibility

The member will take responsibility defending, protecting and compensating Bingo Program in front of any losses, expenses or complaints related to the development of his work and that could happen by the execution of this contract.

Bingo Program will not be held responsible of the damages caused to the member or third parties in consequence of interference, omissions, interruptions, or disconnections, in the access or the net operations, damages, or any sort of fault or mistake in the software or in the use of computer system.

8. Various

8.1 Applicable Law

In this agreement the law in force will be the Dutch Antilles, and the parties will submit under the jurisdiction and the courts of Curaçao, and the parties resign to their own jurisdiction.

8.2 Transmission

In any case, the member will have permission to transfer, substitute or transmit this agreement, except if there is a previous and written consent from Bingo Program.

On approval, the member accepts the terms and the conditions of this agreement, signing the box in the section REGISTER.
