German crackdown raises the stakes for internet gambling

BRITISH executives of online gambling companies could be arrested on criminal charges in Germany if they set foot in the country.

Officials from the interior ministries of the German states of Hesse and Bavaria told The Business that executives of foreign companies who let German residents place sports bets online are committing “criminal” acts that could lead to prosecution in Germany.

Germany’s threat to foreign managers follows the recent arrests in the US and France of executives from offshore gambling firms.

French state gambling officials also plan to adopt a tougher stand: officials told The Business that they will continue to report offences by foreign betting operators to the government, raising the possibility of more arrests of executives at offshore gambling firms.

Attempting to enforce their monopoly on sports gambling, Hesse, Bavaria and Saxony ordered Austrian online betting company Bwin to stop advertising and offering betting services in their states. The ban “goes for everyone else, too,” a spokesman for the Hesse interior ministry in Wiesbaden told The Business.

The hypocritical stench surrounding the online gambling law forthcoming in Washington state includes campaign donations from none other than Indian casinos for State Senator Margarita Prentice (pictured below, Sen. Prentice homepage). Her term ends January 2009. The bill submitted to the Senate is known as SB 6613 and the history shows that it took from January 17, 2006 when it was discussed until June 7 to be enacted into law. Not even five months. Wow, they can move fast on the things that don’t matter, can’t they?

Curiously enough, the Seattle PI article cited below doesn’t mention these heavily biased campaign donations, but KIRO710 Dori Monson read a list of the terrestrial casino donations during one of his recent talk shows.

Washington residents who play poker or make other types of wagers on the Internet will be committing a Class C felony, equivalent under the law to possessing child pornography, threatening the governor or torturing an animal. Although the head of the state Gambling Commission says it is unlikely that individual online gamblers will be targeted for arrest, the new law carries stiff penalties: as much as five years in prison and a $10,000 fine.

So let me get this right: an adult who dials up an online poker site is going to be comparable to someone possessing kiddy porn? If there are any actual convictions, this is proof most politicians have gone insane.

The bill passed unanimously in the Senate and with just five dissenting votes in the House. It was signed into law by Gov. Christine Gregoire on March 28.

The same Christine Gregoire who referred to herself as “Chris” Gregoire during her election run. I didn’t vote for her and won’t vote for her re-election. At least there are five people in the House with common sense but they were drowned by 95 others who favored imprisoning online gambers in Washington state.

The article focuses on online poker which is a game I’ve never played for real online. Not a game I particularly care for, but regardless I am strongly opposed to laws preventing adults from gambling if they want to do so.

Formerly, online gambling in Washington State was a gross misdeamonr, of which there don’t appear to have been any convictions (?) which KIRO710 Dori Monson also mentioned as being strange. How can we upgrade the punishment for a law which formerly had zero prosecutions? Is this correct or were there some confirmed prosecutions? My research as of the writing of this article could not confirm there were any successful prosecutions. Please update in the comments if you can find differently.

Washington state residents, please write to your local representatives, especially the 95 who voted for this bogus and likely unenforceable law. Complain voiciferously. Even if you don’t gamble, the last thing the state needs is to see is online gamblers being thrown in jail and having Class C felonies on their record. It will be very difficult to get this law repealed now.

Across the 50 states, only two do not have legalized gambling: Utah and Hawaii. Is Washington state about to have the harshest law on the books against online gambling? In a state that is literally teeming with Indian casinos — some of which we like to visit occasionally — and a state run lottery with some utterly craptastic odds (like most state lotteries) this law seems incredibly hypocritical.

And now I somewhat expect to receive a (likely anonymous) fear mongering comment about how terrible gambling is for society. Yeah, prohibition worked too (not). Didn’t work with alcohol. Isn’t working with marijuana. Won’t work with online gambling. Let’s find a way to legalize and regulate online gambling, open up gambling to the non-tribal state businesses, tax it so the indian casinos aren’t reaping all the rewards.

A vote in a recent election shot down non-tribal gambling being legalized. Of course the fear was that we’d have slots in grocery stores and right next to schools. That’s how laws which make sense get sullied by political scare campaigns muddying up common sense. Most casual gamblers, of which I consider my wife and I, wouldn’t want slots next to schools, but it’s that FUD that spreads and causes non-gamblers and casual gamblers to vote down legislation.

I like the guy’s spirit in the article that says he may take his wireless laptop to the capital steps in Olympia and play online poker as a form of protest. I’ll donate to his legal fund to prevent him from sharing a cell with Bubba. You?

US lawmakers seek online gambling bill compromise

WASHINGTON, Sept 21 (Reuters) - Congressional leaders are trying to forge a compromise that would allow them to push through legislation banning most forms of Internet gambling, aides said on Thursday.

Top House and Senate lawmakers have been trying to break a logjam that has stalled the Internet gambling legislation by attaching it to any one of a number of must-pass spending bills before the end of the year, aides said. However, they have yet to agree on a final deal.

“I’m confident that (Senate Majority Leader Bill) Frist is intent on trying to make something happen. They are working hard,” one aide said.

According to two sources familiar with the matter, one possible compromise would focus on a version of a bill already passed by the House, with some provisions opposed by the U.S. horse racing industry removed.

The bill would prohibit most forms of Internet gambling and make it illegal for banks and credit card companies to make payments to online gambling sites.

One lobbyist said backers considered trying to attach it to a defense spending bill, but a number of aides said they did not believe it would be possible.

Senate Armed Services Committee Chairman John Warner, a Virginia Republican, has a reputation for not allowing non-germane measures to be attached to defense legislation.

Lawmakers are scheduled to recess at the end of next week so they can campaign for the November elections. They are expected to return afterward to wrap up unfinished business.

EUROPEAN COMMISSION TO TARGET DISCRIMINATING STATES AND ONLINE GAMBLING

BRUSSELS — The European Commission said Monday that it is prepared to target more member states deemed to be stifling free competition in the sports gambling sector.

The move came on the same day as news that a French magistrate formally launched an investigation into contravention of French gambling monopolies by the two heads of the Austrian-German Bwin Internet gambling group arrested last week.

Manfred Bodner and Norbert Teufelberger were freed on conditional release on bail of €300,000 ($380,000) each, one of the men’s lawyers said.

“We will perhaps add to the number of countries involved in infringement procedures” during a meeting of the European Commission October 18 on the topic, said the EU executive arm’s internal markets spokesman Oliver Drewes.

An activity that is illegal for a private operator cannot be legal for a state monopoly, Drewes added.

BODOG MARKETING CONFERENCE CANCELLED AGAIN.

According to Bodog Founder Calvin Ayre, the Bodog Marketing Conference at Atlantis in December 2006 has been cancelled. This was a second attempt to host the online gambling conference, re-scheduled after the cancellation of the Bodog Marketing Conference in September which was cancelled after the arrest of British online gambling CEO David Carruthers in the US.

Citing uncertainty of the U.S. Department of Justice’s recent actions, apprehension by speakers and attendees and stating it was in the best interest of all delegates, Bodog announced their decision not to proceed with the conference and apologized for any inconvenience.

Future conferences have not been scheduled at this time and there is much speculation that the Bodog Marketing Conference is a thing of the past.

ONLINE GAMBLING SPORTSBOOK BETONSPORTS ATTEMPTS TO SETTLE CIVIL AND CRIMINAL CHARGES

BetOnSports, the online gambling sportsbook, would like to negotiate a settlement of civil and criminal charges by the US DoJ against BoS for racketeering and fraud and have asked for a meeting to discuss a possible resolution.

It was reported by STLtoday.com that Assistant Michael Fagan thought the case could be resolved. What this would mean to David Carruthers, the former CEO of BetOnSports arrested on a 22 count indictment for fraud and racketeering, and his case is unclear at this time.

LONDON The detention of the heads of an Austrian online gambling company by French authorities has raised the stakes in a Europe-wide battle between lucrative state-sponsored betting monopolies and their upstart rivals on the Internet, raising eyebrows at the European Commission in Brussels.

The executives, Manfred Bodner and Norbert Teufelberger, were expected to appear before a court outside Paris on Tuesday morning. They were taken into custody last week as they announced a sponsorship agreement between their company, Bwin Interactive Entertainment, and AS Monaco, a soccer team that plays in the top French league….

While the detention of Bodner and Teufelberger raised the specter of U.S.- style enforcement tactics, analysts say the motivation behind the move is different. While U.S. opposition to online gambling has been partially rooted in religious and moral concerns about the dangers of wagering, European objections have stemmed largely from a desire to protect government-sponsored monopolies that generate more then €25 billion, or $31.7 billion, in annual revenue.

As of late Monday, Bodner and Teufelberger had not been charged with wrongdoing, but their detention stemmed from a complaint filed by Française des Jeux and Pari Mutuel Urbain, or PMU, the French monopoly operators of sports betting, lotteries and other forms of gambling.

“We think this is an effort to protect the French monopoly, and it is a disproportionate attempt,” said Konrad Sveceny, a spokesman for Bwin, which recently changed its name from Bet and Win Interactive Entertainment.

The move has attracted the attention of the European Commission, which has been investigating the gambling monopolies of several European Union member states, following complaints that national policies discriminate against private-sector operators like Bwin.

Oliver Drewes, a spokesman for the internal market commissioner, Charlie McCreevy, declined Monday to comment specifically on the case, but warned pointedly that the commission was considering expanding an investigation of state-run gambling monopolies….

ONLINE GAMBLING EXEC FREED

Peter Dicks has resigned his job as chairman of Sportingbet PLC, but he regained his freedom as New York authorities lifted the threat of extradition to Louisiana hanging over his head and returned his passport.

Mr. Dicks, 64, was detained last week after arriving at New York’s JFK Airport from London, where customs officers were alerted to an outstanding warrant for his arrest issued by the state of Louisiana (see Second Gambling Exec Nabbed).

Mr. Dicks was released after two days in custody, but his passport was seized and he was ordered to remain in the New York metropolitan area (see Gambling Exec Fights Extradition).

At a hearing in criminal court in the borough of Queens on Thursday, a judge ordered Mr. Dicks’ passport returned after New York Governor George Pataki withdrew a warrant necessary to extradite Mr. Dicks to Louisiana.

That effectively ended his short but intense legal saga in the Empire State, but jurisdictional questions about online gambling remain.
